TERMS AND CONDITIONS – SAMUEL FUNFLOW

2. PURPOSE

These conditions regulate the purchase of online training services (dance courses) and physical merchandise (clothing/apparel) offered through this website.

3. TAX REGIME (IGIC/VAT)

The owner is tax-resident in the Canary Islands and is registered under the Special Regime for Small Businesses (REPEP).

  • IGIC Exemption: Prices are final and do not include IGIC (Canary Islands Indirect Tax) according to Article 10.1.28 of Law 20/1991.

  • International Taxes/VAT: For physical products, depending on the shipping origin and destination, the customer may be responsible for local VAT, import duties, or customs fees upon delivery.

4. DIGITAL PRODUCTS (ONLINE COURSES)

4.1. Access

Access is granted immediately after payment confirmation. The user will receive login credentials via email to access the Tutor LMS platform.

4.2. Right of Withdrawal and Refunds

In accordance with Article 103.m of the Spanish General Law for the Defense of Consumers and Users, the right of withdrawal does not apply to the supply of digital content that is not provided on a tangible medium once the performance has begun.

  • No refunds will be issued once the user has logged into the platform or accessed any part of the course content.

  • If the user has never accessed the content, they have 14 calendar days from the date of purchase to request a full refund via email.

5. PHYSICAL PRODUCTS (MERCHANDISE)

5.1. Shipping and Delivery

We use Print-on-Demand services to fulfill orders. This means your order may be printed and shipped from a facility located in a different country than the owner’s residence to ensure faster delivery.

  • Estimated delivery times will be calculated at checkout based on the fulfillment center’s location and the destination address.

  • We are not responsible for delays caused by customs or local postal services.

5.2. Returns and Exchanges

  • Damaged or Wrong Items: If a product arrives damaged or if there is a printing error, please contact us within 14 days with a photo of the item for a free replacement or refund.

  • Change of Mind: As items are printed specifically for you upon order, we do not accept returns for size changes or “buyer’s remorse” unless otherwise stated. Please consult the Size Chart carefully before purchasing.

  • Hygiene: Items showing signs of wear, washing, or use will not be accepted for return.

6. INTELLECTUAL PROPERTY

Samuel Humberto Marichal Ibáñez holds all intellectual property rights for the courses, choreography, edited music, and apparel designs. Recording, distributing, reselling, or using the course content for commercial purposes without written consent is strictly prohibited.

7. DATA PROTECTION

Personal data provided during the purchase process will be processed according to our Privacy Policy to manage your order and provide access to the digital platform.

8. GOVERNING LAW AND JURISDICTION

These terms are governed by Spanish law. Any disputes shall be resolved in the courts of Santa Cruz de Tenerife, Spain.
